Section 01 — Overview & Our Commitment

Our website displays real estate listings, photographs, and other materials provided by MLS data feeds and third-party brokers. We are committed to protecting legitimate copyright interests and will take appropriate action — including removal of allegedly infringing materials — upon receipt of a valid DMCA notice.

Important Note on MLS Photos

MLS listing photographs are generally owned by the listing broker or their photographer. If your copyright claim involves a listing photo, please review Section 4 (MLS Listing Data) before filing a notice with us.

Section 02 — Reporting Copyright Infringement

If you believe that content on our website infringes your copyright, please submit a written notice to our Copyright Agent (see Section 7). Upon receipt of a complete and valid notice, we will:

  • Remove or disable access to the allegedly infringing material promptly
  • Notify the party responsible for posting the material that it has been removed
  • Provide that party with your contact information so they may respond to your allegations

Section 03 — DMCA Notice Requirements

To be valid under the DMCA, your written notice must include all of the following:

  1. Identification of the copyrighted work — Describe the copyrighted work or intellectual property you claim has been infringed.
  2. Location of infringing material — Provide the specific URL(s) on our website where the allegedly infringing material is located.
  3. Your contact information — Include your full name, mailing address, telephone number, and email address.
  4. Good-faith belief statement — A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement under penalty of perjury — A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  6. Signature — Your physical or electronic signature.

Incomplete Notices

If your notice does not include all required elements, our Copyright Agent may be unable to process your claim. Please review all requirements carefully before submitting.

Section 04 — MLS Listing Data

Our website displays listing data from one or more third-party Multiple Listing Services (MLS). If your copyright claim involves a property listing or listing photograph, please note:

  • The same listing data is likely displayed simultaneously by many other websites through the MLS network.
  • Copyright claims regarding listing content should be directed to the Copyright Agent of the specific MLS providing the data, and to the broker who originally submitted the listing.
  • All listings on our site are clearly marked with MLS logos and broker information identifying the source.
  • MLS disclaimers are displayed in the footer of all pages containing listing data.

Section 05 — Counter-Notification

If you believe your material was removed in error, you may submit a counter-notification to our Copyright Agent. A valid counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material removed and its location before removal
  • A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification
  • Your name, address, phone number, and email address
  • A statement consenting to the jurisdiction of the Federal District Court for your district

Upon receipt of a valid counter-notification, we may restore the removed material within 10–14 business days unless the original claimant files a court action.

Section 06 — Repeat Infringement Policy

Visions First Realty, LLC reserves the right to terminate, limit, or suspend access to our website in the event of repeated copyright infringement. If you believe repeated infringement is occurring, please follow the notice instructions above and provide sufficient information to assist us in identifying the repeated conduct.
